ATTEMPTED, FRUSTRATED AND CONSUMMATED CRIMEAn attempted occurs when a criminal begins to conduct a crime but does not complete it due to some circumstance other than you simply giving up.
Example about attempted
- Suppose you break into my house but are caught without any of my belongings. You attempted but did not complete a burglary because you did not steal anything. Another scenario would be if you were caught removing my neighbor's fence posts in attempt to gain access to my land. You've only committed attempted trespass; even if you intended to break into my home, you haven't done so, and you haven't even tried trespass because you never entered my land.
A frustrated occurs when you complete all of the essential steps for the crime but fail to complete it due to no fault of your own. This is a difficult example to come up with, because it does not apply to all offenses.
Example frustrated
- Suppose you intend to poison your neighbor to murder him. The poison is then mixed into the food he is consuming. The physicians in the hospital then save his life. Because you didn't truly succeed in murdering him, that's a frustrated homicide. You plainly intended to conduct first-degree homicide, but you were thwarted due to circumstances beyond your control.
A consummated when all of the ingredients of a crime are present. This is the one that is the simplest to illustrate.
Example consummated
- You despise your next-door neighbor and plan to murder him when he leaves for work. You go out and get a gun, and you keep an eye on his house so you can figure out what he's up to. You approach him at the perfect time and shoot him in the back of the head when you're ready to follow out your plan. As a result, he dies. Because everything is present, this is a consummated (first-degree killing). You plotted to kill him (premeditation), and then you executed your plan flawlessly, achieving the exact result you desired.
